Consumer Terms and Conditions – Sale of Goods

1. These terms
What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods, services or digital content.

Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or cancel your order, what to do if there is a problem and other important information. If you think that there is a mistake in these terms, please contact us to discuss.

These terms are governed and construed in accordance with the laws of England, and the courts of England Wales shall have non-exclusive jurisdiction.

2. Information about us and how to contact us
Who we are. We are Salons Direct Ltd t/a Salon Retail a company registered in England and Wales. Our company registration number is 03018632 and our registered office is at Unit 8, Bassendale Road, Croft Business Park, Bromborough, CH62 3QL.

How to contact us. You can contact us by telephoning us on 0151 305 1560 or by email to  support@salonretail.com.

3. Our contract with you
How we will accept your order. Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between you and us.

You must be at least 18 years of age to buy products containing alcohol. All deliveries must be signed for a person of at least 18 years of age, if your order contains any alcohol products. We reserve the right to cancel your order if your age and/or identity cannot be confirmed.

If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because a credit reference we have obtained for you does not meet our minimum requirements, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified.

Your order number. We will assign an order number to your order and tell you what it is when we accept your order. It will help us if you can tell us the order number whenever you contact us about your order.

4. Your online account
If you use our website you will be responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You must ensure that the password is kept confidential. If you believe that your password has become known to anyone else, you must inform us immediately.

We reserve the right to refuse access to the website, terminate accounts, or cancel orders at our discretion.

5. Your rights to make changes
If you wish to make a change to your order (such as changes to the products, delivery address or otherwise) please contact us and we will try to accommodate your request.

If we can accommodate your request, we will let you know about any changes to the price of the product, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change.

If we cannot make the change or the consequences of making the change are unacceptable to you, you may cancel your order in accordance with these terms.

6. Delivery of the products
Delivery options and costs. We offer various options for delivery of products, which you may choose when placing your order. The associated costs of delivery will be as displayed to you on our website at the time of placing your order.

Dispatch. We will endeavour to dispatch orders within 24 - 48 hours of your order being accepted, but this can vary at any time and time for dispatch of these products shall not be of the essence.

When you will receive your products. We and/or any courier we use to deliver products will contact you with the estimated delivery date and time once your order has been dispatched. If there is any delay to delivery by an event outside our control then we, or our courier, will contact you to let you know. Provided we and/or our courier does this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and receive a refund for any products you have paid for but not received.

Collection by you. If we have agreed to let you collect the products from our premises when placing your order, you can collect them from us at any time during our working hours displayed on our website.

If you can’t take delivery of products. If no one is available at your address to take delivery and the products cannot be posted through your letterbox or left in a safe place, our courier will leave you a note informing you of how to rearrange delivery or collect the products from a local depot.

If you do not re-arrange delivery. If you do not collect the products from us as arranged or, after a failed delivery to you you do not re-arrange delivery or collect them from a delivery depot, we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may cancel your order and provide you with a refund.

When you become responsible for the products. Products you order will be your responsibility from the time we deliver the product to the address you gave us or you collect it from us as agreed.

When you own products. You own a product once we have received payment in full.

Late delivery. We will aim to ensure that all orders are delivered to you within the specified time estimates, but we exclude any liability for delays.

Incorrect information. We will not be responsible for delivering the products late or not supplying any part of them if this is caused by you not giving us accurate and appropriate delivery information.

Additional charges. When you request delivery of products to an address outside the UK, you may incur additional taxes, levies, duties and other charges in respect of your order. You acknowledge and agree that you have sole responsibility for any such charges payable in respect of the deliver of your products.

Please familiarise yourself as to whether such charges will be applicable to your order prior to placing your order.

7. Refunds
If you do change your mind about your order and no longer want the products, we have a no questions asked returns policy provided you contact us to let us know within 14 days of receiving your order. To let us know that you’d like to cancel your order, please get in touch by telephone on 0151 305 1560 or by email at  support@salonretail.com

Once you have told us that you wish to cancel your order, you must then return the products to us within 14 days.

All products must be returned in their original condition. You will not be entitled to a refund if the products:

  • have been used;

  • are not in their original packaging;

  • any protective or hygiene seal has been opened or tampered with; or

  • have otherwise been damaged by you.

Original delivery charges are non-refundable, except where there is an issue with the order which is our fault.

The cost of postage and safe return of returned orders are your responsibility. We recommend that a trackable method of postage is chosen, and you hold on to the proof of postage. Once your order has been returned, we will get in touch to let you know it has been received and your refund has been processed.

Provided you are entitled to a refund, we will endeavour to refund those amounts back to your original payment card or account within 14 days of us confirming receipt of the returned products.

8. If there is a problem with the product
If you have any questions or complaints about the product, please contact us via telephone on 0151 305 1560 or by email at  support@salonretail.com

We honour our legal duty to provide you with products that are as described on our website and that meet all the requirements imposed by law. A summary of your legal rights in respect of faulty or mis-described products are summarised below (although do note there are certain exceptions).

Summary of your key legal rights

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product your legal rights entitle you to the following:

  • Up to 30 days: if your goods are faulty, then you can get a refund.

  • Up to six months: if your goods can't be repaired or replaced, then you're entitled to a full refund, in most cases.

  • Up to six years: if your goods do not last a reasonable length of time you may be entitled to some money back.

9. Price and payment
The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order.

It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order.

10. Discount codes and sales offers
We may offer discount codes or reduced pricing on specific products from time-to-time.

Discount codes and coupons may only be applied against full-price products on our website forming part of the relevant promotion.

Discount codes cannot be applied against already discounted products, total orders below a certain threshold, promotional packs, postage or packaging costs, unless we have otherwise agreed.

We reserve the right to suspend, change, refuse or withdraw any discount we have offered at any time.

11. How we may use your personal information
We will only use your personal information as set out in our privacy policy here.

12. Other important terms
We may transfer our rights and obligations under these terms to another organisation.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

These terms are governed by the laws of England and Wales and you can bring legal proceedings in respect of the products in courts of England and Wales.

If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts.

If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
